For the first six months on a junior driver's license, you may not carry more than one passenger under 18 who is not an immediate family member. After six months the limit rises to three passengers under 18 who are not immediate family. The only person whose presence lifts the cap is a parent or legal guardian riding with you. The manual also lists a person in loco parentis or a spouse 18 or older, but the statute names only a parent or legal guardian, so treat that narrower list as the one that keeps you legal. The six-month step up is not automatic. If you have been in a reportable crash that PennDOT considers you partly or fully responsible for, or you have been convicted of any violation of the Vehicle Code, you stay capped at one passenger under 18 who is not immediate family. Immediate family here means your brothers, sisters, stepbrothers and stepsisters, including adopted or foster children living in your household. Separately, no driver under 18, on a junior license or a learner's permit, may carry more passengers than the vehicle has seat belts.
